Abstract
The formaive period in the development of the Islamic legal
tradiion is oten denoted by its lexibility and novelty associated
with the legislaive concept of ijihād. Thus, this funcion of jurists
exercising their jurisic opinion provided a mechanism of renewal and
rejuvenaion that allowed the law to adapt as ime progressed and
as Islam spread geographically. Accordingly, there were numerous
jurists who expressed their opinions on mulifarious issues before the
advent of a formalizaion of the tradiion with the genesis of a limited
number of legal ‘schools’, each headed by an ‘iconoclast’ jurist.
